1. Our respect for copyright
Tech Turtle LLC ("Tech Turtle," "we," "us," or "our") respects the intellectual-property rights of others and expects users and clients to do the same. We respond to clear notices of alleged copyright infringement consistent with the Digital Millennium Copyright Act ("DMCA").
2. How to submit a notice of claimed infringement
A valid notice should include: (a) your physical or electronic signature; (b) identification of the copyrighted work claimed to be infringed; (c) identification of the material claimed to be infringing and its location (URL); (d) your contact information; (e) a statement that you have a good-faith belief the use is not authorized; and (f) a statement, under penalty of perjury, that the information is accurate and you are authorized to act for the owner.
Designated agent — needs owner confirmation: The business must confirm or appoint a DMCA designated agent (and register with the U.S. Copyright Office to receive the statutory safe harbor). 3. Counter-notification
If you believe material was removed or disabled by mistake or misidentification, you may send a counter-notice including your signature, identification of the removed material and its prior location, a statement under penalty of perjury of your good-faith belief, and your consent to jurisdiction as required by law. We may restore the material as permitted by the DMCA.
4. Repeat infringers
In appropriate circumstances, we will disable or terminate access for users or clients who are repeat infringers. We may remove or disable access to claimed-infringing material as we deem appropriate, without any requirement to independently adjudicate the underlying dispute.
5. Misrepresentations
Under the DMCA, a person who knowingly materially misrepresents that material is infringing, or was removed by mistake, may be liable for damages. Please make sure your claim is accurate before submitting it.
